Aggravated Assault with Deadly Weapon

This offense is extremely serious and is a second degree felony carrying from 2 to 20 years in the penitentiary. It is involves the use or the threat of use of a deadly weapon. The weapon can be a gun but also can be virtually anything that is used an a manner that could cause serious bodily injury or death. A plastic bag, pillow, automobile, and so forth could get someone charged with this offense. If a family member is involved that it is a family violence case.

This being a felony, the case would have to be presented to the grand jury for their approval of the charge. If they agree that there is sufficient probable cause for the case to be pursued, they will indict the person charged.

The next step is for the case to be assigned to a court and then the defendant would have to face the situation.
